Event on protecting classified inventions during martial law
On September 12, 2025, Kyiv hosted a successful event entitled “Classified Developments: Patenting in the Defense Sector,” organized by the UBA Intellectual Property Committee in cooperation with the Ukrainian National Office for Intellectual Property and Innovations (UANIPIO).
The discussion focused on the specific aspects of granting legal protection to classified inventions and utility models, particularly under martial law. Participants examined in detail the following issues:
- the structure of the protection system for classified intellectual property objects;
- which types of inventions may be designated as classified;
- what information remains available to the public;
- the typical pathway for an application containing state secrets;
- specifics of interaction with security-clearance authorities and the State Expert on State Secrets;
- the legal status and scope of protection for classified objects compared to conventional patents.
The event was moderated by Taras Kyslyi, Member of the UBA Intellectual Property Committee Council, Partner at Arzinger Law Firm, attorney at law.
The keynote speaker was Dmytro Yankovskyi, Head of the State Secrets Protection Department at UANIPIO, who shared practical insights and outlined the current procedure for filing applications involving classified objects.
The event attracted significant interest among lawyers, inventors, representatives of the public sector, and private defense companies. Throughout the discussion, participants had the opportunity to ask relevant questions, exchange experience, and develop a shared vision for the further evolution of the legal framework for protecting classified technologies in Ukraine.
